Your Workplace Rights
You wake up unfit for work, get an online medical certificate, and then worry — is my employer legally allowed to reject it? Here is what Australian workplace law actually says.
Get a GP-reviewed certificate — $14.95The short answer
Under Australian workplace law, generally no — an employer cannot reject a medical certificate simply because it was issued online, provided it is “satisfactory evidence” and was issued by an AHPRA-registered health practitioner after a genuine clinical assessment. The catch: not all online certificates are equal.
It is a real source of workplace anxiety. And with the rise of fully automated certificate apps, Australian HR departments and the Fair Work Ombudsman are scrutinising digital notes more closely. Many generic apps rely on automated questionnaire algorithms and rotating pools of faceless doctors — which can lead to documents that are easier to challenge.
At Doctors Note Australia, every certificate is reviewed and signed by a named, AHPRA-registered GP — so your documentation is built to stand up to scrutiny.
Under Section 107 of the Fair Work Act 2009, an employee must provide evidence that would satisfy a “reasonable person” that they were genuinely unfit for work due to personal illness or injury.
An employer cannot reject a medical certificate simply because it was delivered via an online platform or a telehealth consultation. Legally, a digital certificate carries the same weight as a traditional handwritten note — provided it is issued by an AHPRA-registered practitioner following a legitimate clinical assessment.
An employer or HR manager may reasonably challenge a certificate in three specific situations:
We were specifically built to close the compliance gaps found in automated telehealth apps. Our platform runs on our proprietary Clinical AI Systems Infrastructure (CASI) — which acts as a real-time clinical guardrail, enforcing medical and legal accountability on the practitioner at the moment of assessment, rather than relying on passive audits after a document has been sent.
Your questionnaire is never handled by a bot or a rotating pool of sub-contractors. Dr Rupinder Singh Walia (FRACGP, 28+ years of clinical experience) personally reviews every single application to ensure it satisfies Fair Work guidelines.
Every certificate we issue carries an embedded Employer Verification QR code. If your HR or compliance team needs to verify your note, they simply scan the code to instantly confirm its verification status — in seconds.
The check confirms the document is authentic and legally issued, while keeping your private medical diagnosis and symptoms completely confidential. Verification confirms the certificate is genuine; it does not reveal why you were unwell.
If an employer pushes back, stay calm. Let them know the certificate is compliant with Section 107 of the Fair Work Act 2009 and was individually reviewed and signed by an AHPRA-registered General Practitioner.
Then direct them to scan the built-in verification QR code. Because the certificate provides immediate, verifiable confirmation that it is genuine, most compliance questions are resolved quickly — usually well before any need to involve the Fair Work Ombudsman.
